Michigan Divorce Process

The divorce process in Michigan starts when a complaint of divorce is filed in court. The other party is then served with divorce papers and given time to respond. If the parties are in agreement about property and debt division, as well as child custody and support matters, the divorce may be finalized without a trial. If the parties do not agree, the court will set a time for a hearing. Some of the issues that may be decided in a Michigan divorce include:

  • Property and debt division. Property or debt obtained during the marriage is typically considered marital property. If the parties cannot agree on how to divide their property and debt, the court may order mediation or the court will decide based upon many factors.
  • Spousal support. If one of the parties requests spousal support (alimony) and cannot reach an agreement, the court will consider several factors to decide whether spousal support is appropriate; the court may consider many factors such as the length of the marriage, the parties’ ages, their respective contributions to the marital estate, and the standard of living during the marriage, to name a few.
  • Child support. Child support is calculated by using the Michigan Child Support Formula. Support is based on the parents’ income, the number of children, custody arrangements, and other factors.
